These Terms and Conditions and any separate agreements whereby we provide you with products and services shall be governed in accordance with English law and jurisdiction.

General Terms

This website is maintained by VSC Wine and Drink Ltd and its registered trademark The Little Fine Wine Company. The terms “we”, “us” and “our” refer to VSC Wine and Drink Ltd/The Little Fine Wine Company, who provide this website, including all information, products and services available from this site to you, the user, dependent upon your acceptance of all terms, conditions, policies and notices mentioned here.

By visiting our site and/ or purchasing something from us, you engage our services and agree to be bound by the following terms and conditions (“Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

Any new content, services or features which are added to the current website/service shall also be subject to these Terms. We reserve the right to update, change or replace any part of these Terms by adding updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the addition of any changes constitutes acceptance of those changes.

Please note that we reserve the right to refuse service or orders to anyone for any reason at any time.

Age Of Purchaser

It is illegal to sell alcohol to anyone under 18 years of age. By agreeing to these Terms and by ordering from The Little Fine Wine Company you are confirming that you are at least 18 years of age. We may ask for age verification and identification and will decline sales, delivery and membership to our Wine Club should there be any reason to believe that you are not 18 years of age or over. For any tastings and wine events, we also reserve the right to request age verification and may decline entry should we not be satisfied that you are at least 18 years of age.

Pricing & Availability Of Stock

All prices on our website includes alcohol duty and VAT as applicable, in UK pounds sterling. All efforts will be made to ensure correct pricing on our website. In the unlikely event of an error in pricing, we will not be liable to provide the wine/product at the erroneous price however will contact you to ascertain if you would like to continue with the order at the correct pricing or prefer a refund in full.

Prices and availability of our products are subject to change without notice. Pricing is reviewed on a regular basis, and we reserve the right to change pricing at any point before a client’s order is both confirmed, paid for and dispatched (or within 7 days should the order be for a gift card or event tickets).

Wine is essentially an agricultural product meaning that volumes are often very limited (particularly of half bottles), and on rare occasion we may therefore have to cancel an order and provide you with a full refund or change pricing (before the point of dispatch of the client’s order) for the follow-on vintage. Prices may also change due to other circumstances beyond our control such as increases in HMRC’s alcohol duty, fluctuation in exchange rates and so on.

Information Available On Our Website

Whilst all efforts will be made to the contrary, we will not be held responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and any reliance on the material on this site is at your own risk.

This site may contain certain historical information which is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Ordering

We will dispatch your wine once your order has been paid for and the delivery date has been set by you. Until point of dispatch when we accept your order and enter into a contract with you, we may reserve the right to cancel the order without reason, to inform you of this and provide a full refund of payment taken. In the case of event tickets or gift card sales, acceptance of order and creation of the contract is on receipt of payment and provision of the ticket itself.

We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we will notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or cancel orders that, in our sole judgment, appear to be placed by wholesalers, resellers or distributors without prior discussion with us.

Payment

Payment is at time of ordering and via our payment provider, Stripe.

By placing an order, you agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

eGift Cards

It is possible to purchase Gift Cards (‘eGift Cards’) from us which provide credit to be used by the recipient of the gift against future purchases from our website. In this case, the unique eGift Card number must only be used by the recipient of the eGift Card. A valid email address must be given at the time of ordering and this must be the same email address used to create the recipient’s initial account and for which credit is used. The eGift Card cannot be exchanged for cash nor transferred to another person, nor used after the given expiry date.

Delivery

We do not currently deliver outside mainland UK but will update our distibution areas on a continual basis, details of which can be found in our Delivery Information page.

We ask for the delivery date to be nominated by you on a day that is suitable for you to receive and sign for your order. If for any reason it is not possible to be present to receive delivery, you may stipulate a so-called ‘safe place’ in which to leave your order. This must be away from public view and from minors. We cannot, however, accept any liability should the delivery be made by our courier company to the safe place as per the correct instructions, but the order be found to be damaged or absent on your return.

Correct information must be given. We do not accept any responsibility for late or non-delivery of goods arising from incorrect information provided at time of ordering.

On receipt of delivery please check your order and sign to confirm your receipt of delivery, making a note of any absent goods or damaged bottles. We will not be liable for wines that are absent from the delivery or for broken bottles if reported to us more than 5 days after the delivery is signed for, nor where incorrect address or other delivery details were given by you. Should the courier company be unable to deliver for any reason caused by you, we will not be liable for the charge of re-delivery at another date/time and will ask that this charge is covered by you prior to re-delivery. This includes where the order was purchased by you as a gift for another, and where delivery details or chosen delivery date are incorrect, requiring a second delivery (and re-charge).

Title Of Goods

All wines and any other products sold by VSC Wine and Drink Ltd/The Little Fine Wine Company will remain our property until full payment is received. They will become your responsibility once they are dispatched and delivered to the delivery address that is given at the time of ordering or that is otherwise advised by you prior to dispatch.

Order Cancellation

An order may be cancelled until the point of dispatch by us. Please contact us immediately should you wish to cancel your order on info@thelittlefinewinecompany.co.uk or on +44 208 0895150.

Refunds & Returns

All efforts will be made by us to provide you with wine in perfect condition and as intended by the winemaker. We test our wines for quality control purposes and the event of a faulty or corked bottle is unlikely. If, however, you do find a faulty bottle, please contact us immediately (and within 3 days of opening the bottle) at info@thelittlefinewinecompany.co.uk to arrange a replacement bottle or refund if a replacement is not possible. We will ask for the bottle to be returned by you (at our cost) for analysis.

Please note that we provide drink by dates for each wine. While these are only a guide, should the wine be kept for considerably longer than the drink date or in poor storage conditions, we may not be able to provide a refund.

You may return your order for any reason within 14 days of receiving it should the wines remain unopened and in good, resaleable condition. We must be advised in writing in this instance to info@thelittlefinewinecompany.co.uk so that we can contact you to arrange collection. In this event, we reserve the right to charge a collection fee as levied by our courier company, but otherwise all fees will be refunded in full within 14 days of receipt by us.

You may cancel your order of a eGift Card within 14 days and receive a full refund from us within 14 days of confirmation in writing to info@thelittlefinewinecompany.co.uk.

For any wine tasting or other event tickets, we require 14 days’ notice prior to the event in order to provide you with a full refund should you wish to cancel your order.

Force Majeure

The company shall not be liable for any failure to meet its obligations if this failure is caused by circumstances outside its reasonable control.

Intellectual Property

Trademarks, copyrights, database, branding, logos and all other content on this website is the sole property of VSC Wine and Drink Ltd/The Little Fine Wine Company and is prohibited for any purpose other than viewing for information purposes and for ordering transactions.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

Third-party Links

Certain content, products and services available via our website and company may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. User Comments, Content & Submissions

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by post, by social media or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms.

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the service or products provided by us or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

Terms & Conditions For Our Wine Club

In addition to the Terms mentioned above, the following apply to those who subscribe to the ‘Wine Club’ managed by us.

Subscription Cases

We reserve the right to limit sales to one of each type of subscription case per person per month.

Substitutions

Very occasionally it may be necessary to substitute a wine within your subscription case for one that was advertised, in which case, a wine of at least equal value will be chosen as the substitute, and we will let you know prior to dispatch in case you would prefer to skip that month’s subscription or cancel entirely.

Pricing

The price of our subscription cases is subject to change. You will always be notified should prices change, prior to payment being taken, order confirmation and delivery, and given the option to skip or cancel your subscription via your online account.

Cancellation & Changes To Your Subscription

You may cancel your subscription to our Wine Club at any point via your online account. You may also skip a month’s subscription. Payment method, delivery instructions and account details may also be changed at any point via your online account. Please note that subscription orders may be cancelled or changed in any way only up until point of dispatch, which will be confirmed to you.

Payment & Delivery

Subscription cases are billed on a monthly basis, recurrently, until cancelled by you via your online account. You will be contacted several days before the next month’s case is ready to let you know the wines for the next case, when payment will be taken and when delivery is planned. At that point you may cancel the subscription, skip that month’s subscription order (in which case no payment will be taken) change the delivery date, or other details. Note that once payment has been taken and the order has been dispatched, you will not be able to change details for that order. Our usual ‘Refund and Returns’ terms and conditions apply (please see Terms above).

Membership & Benefits Of Our Wine Club

You may skip several months’ subscription orders and retain your active subscription and membership, however, we reserve the right to withhold any benefits to your membership should you skip more than three months’ subscription orders.
